Is there anyone who's had problems with the agency, in terms of not getting paid? What did you do in that case? Is easy to recover the money that they owe you?

Depends if the agency has any money to pay you.

Its been said many times, but its no use taking them to court if they dont have any money, it will just cost you more in lawyers fees etc.

If this is a reflection on amount of effort and research you are going to put in when trying to get out of this situation I would just write it off and walk away.

Well, this is not a reflection of anything...
Obviously I am trying to get information from other sources, to avoid this to happen when the time comes. It was just to see other people's situations and how do they deal with them. That's all!

Always been a perm... so I am new to this contracting world and I find so ridiculous that this kind of situations could happen... working and not getting paid! It just does not make sense

mcontracting, Best just to ignore northernladuk, I do, he seems to specialize in unhelpful, rude and obnoxious posts to newbies....

I sympathise with your situation, however haven't experienced it myself so can't really advise. As mentioned before search threads on here for some previous advice. Also if you have access to PCG forums this has been discussed in great detail on there previously.

it happens. always watch the first invoices like a hawk. make sure that they get processed as the schedule promises. actually, watch all the invoices like a hawk - though tbh i don't once the first ones are paid.

in fact, you should get analysing the timesheet, invoice schedule, emails and contact details well in advance of processing your first invoice. make sure that you know exactly what to fill in and where to send it. if the forms and processes appear flaky then the payments might be too.

if there is any delay get on the phone to the agents immediately. if the excuses don't seem good then prepare to walk. have dialog with the end client and get them on your side. the agency should protect their client relationship and pay you promtly. if they still don't pay - walk. who wants to work for nothing?

you can add interest to your unpaid invoices. you can pay firms to collect your overdue invoices. you can go to court - but don't let it get to that.

if you are a newbie they may well try hanging you out there.

i've had trouble twice. the first time i was new and didn't know what to do. the agency went bankrupt. i nearly did too. the second time i shouted and got nothing... i spoke to the clientco and walked. the clientco screamed and i got paid in dribs and drabs. i was still diddled by a few grand at the end but i let it go rather than go through the hassle.

the agency the second time went belly up a short while later.
