I think it's a war that has been lost too. The damage done is too great.

One interesting quote:

It added an additional requirement to the ICT rule that "a migrant employed under ICT must not be directly replacing a settled worker".

Peter Skyte , national officer at Unite, said the requirement that has been added was originally part of the ICT rules but had disappeared in later versions. "It was the result of pressure from Unite that this was put back in."

According to the Border Agency website, a settled worker is "a person who is a national of the European Economic Area or is legally settled in the United Kingdom with permission to work here.

Does that mean that, as I have always believed, that all of the ICT are now fraudulent? I the PCG had any balls they would be on the dog to the lawyers seeing if they can force the government to publish the details of all ICT so that those on the bench can apply for the roles. Yeah, right HAB. As if the PCG will do anything that helpful.

However, spare a thought for the fallen. There are thousands of IT folk who have had their careers destroyed by ICT and will never work again. None of them have ever received any help and never will.

Jesus, can't win, can they? Do you really think this would have happened wthout them raising the issue in the first place? It may well have come too late, but it's certainly not too little. It will also force a reappraisal at the client end, which is where it matters.

He's right, MAC's output is strictly advisory. Sadly for him, the UK Border Agency's rulings are not.
