If you're opted in and you turn up and the client signs your timesheet the agency have to pay you. It makes no odds to you if the relationship between the agency and client is breaking down for any reason. If the agency aren't getting paid by the client that's their problem not yours.

If you're opted out check with the client what the story is and try to come to an amicable arrangement. Worst case you finish 2 weeks earlier, no great shakes.

Not a good time to opt out in my opinion.

This is a difficult one. Check your contract, and you'll be due any work you've done plus the notice period. Start looking, that contract is now over, as the client is in financial difficulties. You can probably start a new contract with immediate effect.
          I'm alright Jack

How is it enforced? Through the usual court action?

That's what VNG thought when Ferantti were in trouble.

No other agency would touch them and VNG thought that they were onto a nice little earner as Ferranti would pay them eventually,

                  Until, um they didn't

Never say that mate. LOL - It doesn't matter how aggresive they are or whether there all former Clifford Chance, Manches or A&O - what matters is who else is in the line that are above you for debts.

Yeah. It's unwinnable for them, unless they can produce a signed opt-out statement. Since it's that cut and dry I'd be suprised if an agency didn't cave in and pay up after you made the initial step of simply sending a letter from a solicitor. If they fight it so much the better, add the court costs to their bill.
