    Renewal-Monthly Rolling-No End Date-IR35

    Dear All,

    I am currently due for my contract renewal. The client is happy to renew the contract on a rolling monthly basis with no end date. I know this is good in a way but at the same time not sure what would be your take on IR35 status.

    By signing a contract with no end date, am I putting myself in trouble to give a view of "Permie in disguise"

    I am anyway going to send the contract to my IR 35 insurance provider but just thought to take your views as well....

    Please let me know.

    Without looking at the contract in detail, it would be hard to answer this. You are doing the right thing by getting the contract reviewed by an IR35 specialist.

      If it's being renewed on a monthly basis then it does have an end date - the end of the month.

      Then, each month, you and the client agree to change the contract such that the end date is the end of the next month. You both sign the agreement to modify the terms of the original contract and away you go.

        Can't really see it being an IR35 indicator one way or the other, on it's own. However, not knowing what the rest of the contract says, or what the working conditions are, we can't really say.

        I'd be interested to know what the experts say when you get a response back though.
