    As they invoiced for the money then it is theirs. I'm sure you could argue this in court, but by that time they will be long gone.

      No you can't, the gross was never yours as soon as you effectively agreed to work for TRM at your salaried rate (or whatever the company was) and they invoiced the agency you were an employee and nothing more. Any profits over and obove your salary belong to TRM.
      The gross is legally theirs and short of standing up in a court and basically stating that you knowingly engaged in a tax scam (evasion not avoidance) by deliberately hiding your income which would land you in jail you couldn't challenge them.

                  TRM are under HMRC investigation. If you want to use an EBT based scheme then I suggest you consider using Steed.
