PGC Contract

Hi All,

my Agency has used a standard PGC contract for the agreement betweem my LTD and themselves. The question is do I need to spend money to get this checked out for IR35 compliance?

How do you know that the contract is a standard PCG (I assume you mean PCG) contract? Did the agent tell you, or have you verified it yourself?

If you're verified it yourself, then you'll be fine. Otherwise, never believe an agent who tells you a contract is PCG standard/IR35 compliant/whatever (delete as appropriate).

Many offer IR35 friendly contracts that are not.

If they (The Nasties) determine that you, the contractor have a contract of service, and are employed on a given contract with the client, then IR35 applies and tax and National Insurance liabilities should be the same as if you were directly employed by the client.

If you, as the contractor are deemed to have a contract for service, then you are considered a genuine self-employed independent contractor or service supplier, IR35 does not apply.

Read the terms of contract very carefully OF & FOR (Marked in bold & underlined) are critical.

ADVICE = Get it checked and Get Insurance.

Hi All,

I assume its a standard PCG contract since there is a PCG approved logo on each page ofthe contract with an approval number.

The agency is Abraxas.

Also along with the contract came a fachsheet about PCG.

Probably a valid PCG contract then...

The logo'd ones are not supposed to be amended in any way other than filling the blanks for schedules and company details and the like, so it should be pretty safe for IR35 puposes, assuming it does actually reflect your working conditions.

You can get it checked (Accountax will do a free review of PCG contracts for PCG members) but it should be OK

my Ltd Co formation has happened this week in a real hurry.

so i have lots of paperwork to get through this weekend. I will tee up a PCG membership online at somepoint during this weekend, and get the contract reviewed next week.

can't wait to move away from Giant and run my own business.

Mine's the same. I didn't bother getting it checked, but I did read it carefully myself to be sure of the usual clauses. I also downloaded the PCG template contract to compare, and a lot of it was word for word.
