    badenoch and clark

    Anyone worked through "badenoch and clark" before?

    Im currently being steered to working through them by a client ( it was going to be a direct gig but the client wont budge from its IR35 nasty standard temp terms). Solution is for to go through an agency (at the clients expense), and they have suggested I use these guys as they are one of their preffered suppliers.

    Looking for opinions on them. Especially as to if they are an IR35 savvy lot.

    I work through them - my 1st contract. They are absolutely great - no problems, named contact who is helpful, get taken out to lunch now and again. Other contractors who work on site through other agents are jealous. They are IR35 savvy and my contract is fine. If you want any more info, just say.

      Thanks Greg, thats a relief to hear! With regards to IR35, can you expand a bit more on 'fine'? Did you have someone review the contract or was it based on the standard PCG watertight model? Did you need to push for inclussion of the important 3, ie taken from pcg site

      1. A substitution clause allowing the work to be performed by another person provided by your freelance business;
      2. A clause specifying that there is no "mutuality of obligation" between the parties;
      3. A clause stating that you will not be subject to supervision, direction or control as to the manner in which you render the agreed services;

      Or where they there allready in the standard t+cs that they use?

      Thanks much. And the idea of a free lunch or 2 doesnt sound too bad either. I think I got one free coffee out of the last agent I went though

        The standard T&Cs (filename IR35_TOB) were reviewed and fine. It certainly had 1, can't remember the others but if you'd like to see the T&Cs, I can email them to you.

          Thanks, thats all I need to know really. Im sure they will send over the T+Cs in good time, i was just trying to get a head start on what to expect. I will make sure to ask for the version you mention (IR35_TOB). This is seriously good news.

            That reminds me - the only problem, I did have was that they initially sent the incorrect TOB. If they post it to you, make sure it's title is:
            Standard Terms & Conditions of Engagement
            for Limited Company Suppliers on Projects

                I found them to be OK.

                I never had a contract with them, my named contract popped a sprog and left. No-one thought to tell me untill I stopped sending ni timesheets (when project ended).

                  contractor payment company

                  Hi one I have used and never had problems with is Earn Extra 01484 713147. I dont use them anymore as I am PAYE but would do if I needed them.
