    Have I Been Stitched?

3 months ago, I was due to start a contract but the client cancelled without telling anyone. I'd already signed my contract with the agency but the client didn't sign theirs claiming they never recieved it in the post. So I turns up on the day to find out I've no contract. So I invoiced the agency for one day's lost work. 3 months later, they're saying the client isn't paying up so they're not paying me. Can this be right?

Did you opt out of EB regs?

Actually, I did, but on the assumption thay they didn't apply as I'm a limited company. I don't really understand what these regulations are about anyway. Can you advise?

Basically the EB regs mean the agency has to check your references and pay you if the client doesn't pay, pay you on time etc.

You possibly could get the days pay through litigation but for a days pay is it really worth it. Just write it off as bad debt and let the accountant use that for any tax saving he can.

Good suggestion. Similar thing happened to me last month but the agency did pay me as a goodwill gesture (there are some good pimps out there!) as I had earned them a sh*t load on a previous 12 month gig.

If you'd opted-in they would have to pay you. That's what the regulations are there for. It has nothing to do with Ltd companies or IR35.
