Agency kicking up a fuss over notice period

    I'm not ridiculing you, I'm getting frustrated at you not listening and thinking. For starters we've been over most of the points here in the previous thread you started about 4 weeks notice so you knew full well this was coming.

    In that thread I told you already you'd not get your last pay and I (and not just me) told you not to dick about with sickies.

    I've also told you about using correct terminology to identify the players in the game in this and other posts in the past and you are still trotting out 'line manager' and 'pay' from the agency.

    You've not listened to a single thing or made any effort to understand it so it's very frustrating. Every post I've put on this thread has had factual advice for you even if it's also demonstrated a modicum of frustration. If I have to get frustated to point you you need to start thinking about it more then it's still kinda feedback for you.

      Who said I didn't listen? I served my notice as 2 weeks and im sticking to it. The brolly is now complicating matters by saying they always side with agencies, so now im trying to figure out the best course of action, as it'll have an impact on my P45 (date will be what they say, rather than what I say). The fact they openly said that they will withhold money is a spanner in the works as it renders it pointless to work. So i'll just self-certify sick as im fed up with these tulips, they can withhold whatever they like. Not much else I can do.

      Just to add, because of what Paystream said I'm now moving to another brolly.

            The point was you said 'Who said I didn't listen?' and then you went back down the sickie route when you've been told not to bother. You are clearly not listening. I also explained to you the agency is not withholding your wage. That is paid to you by the umbrella. So again.. you are not listening.

            I'll tell you what to do.... even if it's just to end this shower of a thread.

            You inform both the client and agent of your intention to be available for work after X date. There will be no options or further negotiation. You cannot move the date and will not be working past this date. That's it. End of. Nothing more.

            The agent will send you another mail saying you must work to Y date. You can respond and say your previous communication is the final say in this matter and you consider the issue close if you really want.

            The agent will kick up a fuss, you'll get some grief from them and it's highly likely they'll withhold any money that is owed. You said you aren't bothered so that's that. They may even threaten to sue you but they won't.

            You leave on the day you said and you start the new gig.

            That's it. Job done.

            Of course the umbrella will side with the agency. They are the one honouring the contract. They won't side with you because you are breaching contract. The brolly can also lose money with you breaching so they won't be very impressed with you either. It's the contract between you and the brolly you are breaching as well so quite possible they could be the ones getting sued thinking about it.

            Nothing else to say. No sickies, no holiday. Give a date and leave and suffer the fallout for a bit.

              You needed to go one of two routes from the get go:
              1. Be totally above board and appeal to their better nature to get out early
              2. Be totally sneaky and not come in for the last two weeks
              Instead you have overthought it and ended up in a right mess. I don't think you have any other choice than to cut and run now, quite possibly taking a hit with money.

                I get all that. I'm asking why you would knowingly work, if you know the agency will withhold the money? i.e. You'll be working, knowing you wont be paid a dime.

                  I tried #1, it didnt work. The client hasn't raised any issues, its only the agency stirring things up. They want their margin. It's so small, I'd pay it out of my own pocket if they asked lol.

                  You're right, its turned into a total mess. First time in this situation, so doing my best to figure it all out.

                    Forget NLUK's lack of bedside manner for a minute and think about what you've written there. You served your notice as two weeks, but you were contractually bound to serve four. What part of that do you see as you not being in breach?

                    The brolly, agency and client will have far larger business relationships with each other and you'll just be seen as a problem.

                    Do you know if the end client know what your actual day rate is rather than what they're being charged for you?

                      So ask them what their margin should be and to send you an invoice - that should shut them up.
