    Notify Agency

    Heres how it works.

    As I expected I am finishing at Christmas however he also said that I was really good and he'd recommended that the other company in the equation (DHL) take me on for the remainder of the project (they have some work, all his work is finished as is the budget for me). Its looking like they might do this.

    The work will still be on the same project, but I would be contracting for a different company.

    Do I need to tell the agency that I am doing this as they might want a cut of the action. I'm tempted to ignore them and go direct (i can survive without the factoring) but as I am working on a project they introduced me to do I need to pay them something.

    I have no contract or anything from B&C is there any statoury claims they can make?

    Or will I get blacklisted

    Do you mean that you have no written contract? You may have a verbal contract though.

            Yeah....I believe that some agencies operate internal black lists but not that there is a global black list...maybe that could be my plan D...

                If you had a written contract, it would probably name Tesco as the client and have some clause about not going direct. They couldn't stop you going direct with another client, even if it happens to be related.

                If you don't have a written contract at all, then unless you specifically discussed this, I don't see how they can have any claim on you. They might have a seperate contract with Tesco that could cause an issue, but it seems unlikely.
                Will work inside IR35. Or for food.

                    If you leave a contract with Tesco and take a direct gig with DHL, even on the same piece of work, no court in the land will claim you are in breach of any constraints that concern the gig with Tesco. Tell them to go and play in the corner, it's none of their business - literally!

                    Incidentally I did much the same - went from a contract through agency A for a consultancy on a client programme to a role with the same end client though Agency B, actually implementing the process I'd designed for the consultancy.

                    Agency A weren't happy but couldn't do a thing about it.
