I've recently set up my own Ltd Company and will be undertaking short-term locum social work roles in local authorities around the country. I will be given a caseload, and be expected to manage this caseload autonomously as long as all work is completed within the statutory guidelines. I will not be receiving any staff perks, will have a contractors pass, and will be able to complete work from home when I chose to. Due to the nature of social work and confidentiality, I cannot get away from needed to use local authorities laptops and computer software. I also feel that the supervision element of IR35 is unfair to put on social workers. Our supervision is psycho-analytical and not used for direction or management. This is also a mandatory element of our registration with the HCPC.
I'd never even heard of IR35 before but now its really confusing me as to what is considered inside and outside this legislation. Does anyone have any advice/previous experience with IR35 and social work? I'm a little lost with it all at present so any advice would be much appreciated.
