    Capita. BET. CL1

    Hello,

I wonder if I could get some advice please..

I'm returning to a NHS contract after a period of 7 months in a contract after i finished my NHS contract last October.

I have been advised that I need to come in to the business via Capita and my chosen agency Hays.

I've been filling in all the mountain of compliance documents and I'm now left with a final CL1 tax assurance evidence single sheet of paper that I need to fill in..

    https://docs.google.com/document/d/1...it?usp=sharing

Could any of the group advise me if this form is out of date, seeing as the BETs were scrapped?

How can I assess which risk factor applies to me?.

I have just started my Ltd company a month or so ago.. so I'm pretty wet behind the ears but learning fast (I was using an umbrella in the past).

    Any help / advice appreciated.

    Thanks.

I would simply attach a note to the form saying that you can't fill it in as the B.E.T. have been abolished, and that you would like guidance on how to proceed.

Who advised you that must work via Crapita?

You should point them here - https://www.gov.uk/government/public...s-entity-tests

Also, take this opportunity to ask them for a confirmation of arrangements letter from the client so that you can ensure that you can determine the IR35 risk as they request. When they resist, inform them that you are trying to ensure that you are looking to provide assurance that your tax affairs are in line with the intermediaries legislation, but you are not in a position to tell because you don't know what the working practices will be.

There are quite a few Departments that are using Capita as prime contractor, Capita then use the mainstream Agencies as a resourcing tool. In this case Hays.
I did an MOD one via Synergise (or whatever they're called) last year. It's a bit annoying, but it does work after a fashion.

I was asked to fill out the BETs last month for a DWP role. I told them to shove it.

Did you tell them to shove the role or the BETs requirement? If it was the latter, what was the response?

It's because CRAPITA now run the on-boarding process for contractors / temp workers as per the NHS England agreement with CRAPITA. As far as I understand some lower rate contractors (sub £220 p/d) may still end up going though an agency which may still be on a NHS CCG provider framework..

I however must go in via CRAPITA, who basically provide you with a (long) list of agencies who they deal with.. I've literally been filling in forms for around 2 weeks. And the level of incompetence between the agency and CRAPITA frankly astounds me.

This final document is the one thing which really stumped me, but I was on the same wavelength as all the replies to my post with regards how I should not be filling it in.

I'll let you know what they say, but they seem to be adamant that it's required!
