    Signed Contract

    Hi Guys

    Where does one stand legally if a Contract has been signed but not yet started ?

    Reason, I ask, Im due to start in a couple of weeks and I have signed contract, but Ive also had another offer since

    Can they take legal action against me if I revoke my acceptance ?

          Yes they can. They can try and sue you for losses incurred although realistically these will be very low, just their time to replace you. Even more realistically they won't bother taking it legal but there will be an awful tulip storm that will kick off with some pretty threatening language from your agent. Bear in mind also that the client will feel extremely let down as well so even if you get away with the legalities of it this could come back and bite you in the future.

          Give notice and exit gracefully then. That's what the notice period is for. If the notice period is short enough and they had enough candidates to take your place it might not be as bad as it can be.

            You've already lost one contract because they wouldn't wait for your notice period. Now you're going to ditch a contract you haven't even started yet. You're going to end up with no contracts at this rate.

                    Back on topic. Does the other contract you want start sometime in the future as well? Waiting anything over a week or two for a gig increases the risk they will pull it before you start dramatically. If you are jacking a gig in you are waiting to start in favour of another gig you want that starts in the future there is a very real possibility you will end with absolutely jack tulip.
