      You can't. Nobody at HMRC knows. I have been in contact - today - with both the CTD team and the HMRC policy unit who will decide.

      I've challenged my MP to ask Gauke to state whether the APN legislation will result in a different end outcome for someone settling the APN with a CTD compared with settling the tax bill without the APN legislation. If the end outcome is different, the APN legislation is clearly retrospective.

      There isn't much time. Once the HMRC policy unit decide I would expect Gauke to stick up for it ....

      Finally, settling is a bad idea as if Montpelier do eventually succeed you will be stuck with repaying the performance fee (assuming you joined pre 2004)

                      With all this nonsense about APN's and Follower Notices doing the rounds I am beginning to wonder if the best outcome is if Montpelier give up the ghost...

                      Those in receipt of a follower notice or APN, especially if they purchased a CTD would probably be sensible settling. Lets see - HMRC policy promised to get back to me by the end of the month.

                      Got a mail merge response from Gauke regarding my question surrounding CTD's from several months ago - he didn't answer the question. Just the usual guff about doing the right thing by the "compliant" majority....

                      Of course I am still expecting HMRC to do the right thing
