    Not one of these taxes existed 100 years ago...
    Actually most of them did exist at least 100 years ago, most of them much longer.

              as part of disclosure for the appeal case can our counsel request this info and force HMRC to hand it over??

                You would think that, in the interests of due diligence, HMRC would have taken the initiative themselves to conduct a search for treaty claims prior to 2001.

                However, even if they had found some which had gone unchallenged, they couldn't apply s.58 because of the 7-year cut-off for opening enquiries.

                I believe Counsel are trying to push for more candour in this area.
