            Complaint to HM Treasury

            Since we seem to be hitting a brick wall with FOI, I thought I'd give the Treasury Complaints procedure a try. Ultimately, this could end up with the Parliamentary Ombudsman.

            This was sent today.

            Dear Sir or Madam,

            I wish to bring a formal complaint against officials of HM Treasury for grossly misleading the former Financial Secretary to the Treasury Jane Kennedy over the impact of the retrospective provisions of Clause 55 of Finance Bill 2008.

            On 10th June 2009, Jane Kennedy was asked to comment on the attached survey (s58 FA2008 Survey.pdf), which had been requested by the Parliamentary Joint Committee on Human Rights.

            On 22nd July 2009, she responded by issuing the following statement:

            “I remember the debate and was content that, having questioned officials closely on the impact of this proposal, very few would be affected, certainly not in the way that your attachment is suggesting.”

            However, according to figures obtained through FOI, at the time Budget Note 66 was published on 12th March 2008, HMRC already had over 3000 tax returns under enquiry, of which almost half (1400) dated back to 2003/4 or earlier.

            It is simply not possible to reconcile what the former Minister says she was told by officials, namely that “very few would be affected”, with the figures supplied by HMRC. Indeed, at the time when officials were briefing the Minister, there could have been no doubt whatsoever that the proposal would affect large numbers of people.

            Had the Minister been told the truth, I do not believe she would have agreed to the proposal in its present form.

            I look forward to receiving your response.

                Timms "fair tax"

                All we hear about from Government is that everyone should pay their fair share of tax. Well, according to AccountingWeb, this may be more tricky than HMRC thought:

                The following is based on income of 80K and simplifies details such as no expenses for a LTD company and using only dividends.

                So there it is. IR35 is the most unfair of all the tax systems. Or as Timms might think, if you pay more tax than you would do as an employee then that is fair.

                      Me too. I wonder if there are a few more like us? When they get
                      beaten in the JR, shall we all chase them up at once for the money
                      we're owed?

                      2000*£2,000 would be quite a nice kick in the teeth for the HMRC
