Apparently it might be possible to monitor the traffic coming from HMRC's network.

It would be great to know how much time they spend reading this.

I bet they are reading it at home as they are saddos with no life. I know as my ex-wife is one.

And just in case the judge is reading this - if we lose we will know it was bribery/corruption. Our evidence is overwhelimng.

Also we are not just here to crush HMRC - but Jones too. I think John Cuddy is a total ass - but I hope he wipes the floor with Jones in March.

Would PWC be likely to proceed if our result is favourable or do they still need to pursue their challenge?

Even if we win, I would expect PwC to carry on since they couldn't be sure our ruling wouldn't get overturned on appeal.

Just had a thought. What if we win the JR - and any subsequent appeal - and the bit of the Finance Act dealing with BN66 is declared to be incompatible with our Human Rights - what happens next?

For the retrospection to be removed, doesn't the government have to amend the Finance Act? But I thought that the Tories were committed to repealing the Human Rights Act. So if they win the election then they could legitimately ignore the court ruling (or is that also retrospective?). Not that I trust Labour but they are committed to the Human Rights Act so surely more likely to repeal the offending articles.

Don't get me wrong I've loathed these creeps since day-1 but is it more in our interest to vote Labour than vote to get them out?

Don't vote Labour - they did this. They also "did" IR35.

If we win the JR and subject to any appeal then the Court will make a declaration of incompatibility. It will then be for the government to change the law.

If they were to refuse then we would have to go to the European Court (one of two depending) who would demand enforcement. No action could lawfully be taken against us.

Even if the UK HR Act was repealed or modified it will not change the ECHR and so our rights would be protected. If I recall we were memebers of ECHR long before the EU - it would take a new treaty or a war to remove us from this obligation.

There is no way out of the legal process, other than striking a deal I suppose.

Who created the lie?

Timms and Kennedy told Parliament things that, it would appear, were not true. But did they know they were telling lies, or were they lied to too?

They have corporate responsibility for their department but whether they would "fall" under this act depends on whether they were aware of the lie.

Hartnett comes across as a thug and a bully - it would not surprise me if he had not told the MP's the fully story. If that is so, he should be fired without pension. History is full of leaders who took their "mission" too far - has power went to his head?

Somewhere along the chain someone created the lie. It wasn't the local tax inspectors - they followed their guidance (for the most part).

Was it the Foreign and Trusts HMRC people?
Was it the SCI department in Liverpool?
Was in someone in the Whitehall department?
Was in Hartnett?
Who signed off the section of the Finance Bill?
Was it Kennedy and Timmms?

Isn't it important to weed out corruption before it spoils the entire department? One bad apple....
