BN66 - the road to Judicial Review

    To all, a big thank you for the efforts you have made on this issue. Up until now i have been relying on information from MTM on this issue. With being busy with work i have put all this to the back of my mind up until recently and hopefully justice will prevail.

    I just wonder if there is anything we can do to sue HMRC for incompetency. I, like everyone else, have declared all my earning on every tax return since 2003 when i joined the scheme. Apart from glib letters basically saying they do not understand my return nothing was ever mentioned about this 1987 clause or padmore. if it had of been i might not be facing bankruptcy.

    Cannot make it as i live and work in the north and cannot take any time off but will be following this as closely as i can.

      That's because the 1987 Padmore thingy didn't even occur to them until October 2007.

        I would love to attend the JR, but unfortunately I won't be able to attend as I'll be away - I shall keep up to date via the forum though.

        Thanks to everyone who has contributed on this forum so far and remember, whatever happens at the JR there will probably still be a long way to go.

        Here's hoping HMRC get what they deserve!

            I hate to think the worst but has anyone sought professional advice on their position with HMRC should we lose ?

            I would be interested in any recommendations from the forum.

              Well you could start with the TREASON & FELONY ACT 1848. Go have a read. But you'll have to Google to marry off the Act, tax and hint... the EU.

              And before you think what you find is all BS, I can tell you that is not the case.

              Start off with http://www.express.co.uk/posts/view/104624 and read one of the posts referring to the Act, then go do some research.

                  Both parties have so much to lose on this issue.

                  HMRC want to establish the principle of retrospective taxation to warn off tax planners such as Montpelier.

                  Montpelier have agreat deal to lose both financially and in terms of credibility if the case is lost.

                  It seems inevitable that whoever loses will appeal.

                  Needless to say we the users are caught in the middle and the only ones who could end up bankrupt or losing homes.
