    Update - FOI requests

    Over 25 FOI requests have been submitted so far:

    What to do next

    1) In a few weeks time you will get a response from the Treasury FOI Team denying the request. At this point, use the FOI website to request an Internal Review.

    2) A few weeks after that you will get the outcome of the internal review, which will just confirm their previous decision. The final step is to complain to the Information Commissioner (ICO) using this on-line form.

    There is a backlog at the ICO but if a lot of people complain about the same topic it might just speed up the process, and it will also demonstrate that there is genuine public interest in this.

        Human Rights Committee
        Timms responded to their letter but didn't provide the info they asked for. Unfortunately, the Parliamentary summer recess has delayed things.

        The committee meets again on Tuesday 13th October, when they will consider their next move.

        Judicial Review
        We are still waiting for a court date. There is an outside chance of it taking place before the end of the year, but most likely Q1 2010.

          Perhaps we've misjudged them.

            Well given the UK signed up to the Human Rights Act in 1998, then surely HMRC should apply this retrospectively 10 years if they really want to avoid discrimination? I mean, they knew about Human Rights for 10 years and did nowt, yet they only choose to apply BN54 prospectively. I really like their (in)consistency

            Oh, and the best bit, "your country does not have a DTA so therefore we'll tax you. If you do have a DTA we won't - unless you use a scheme. And Jack Joe is meant to have legitimate expectations? Yeah, right!

                      there's the old £200m quote again...deja vu and a load of guess work rubbish from HMRC to justify legislation...

                      what I dont think is balanced or taken into account in the article is the amount of Corporation tax lost due to the move away from dividend payment low salary structures used by a large number of LTD's that shut up shop following IR35. Or for that matter people who went perm once IR35 was imposed, on a lower salary actually yielding lower tax contribution from the individual than they were paying as an LTD thru personal taxation on divs, and CT on company profits...
