      If the JR goes against us, then it either gets appealed
      and we go around all this again, or we head off to Europe.

      I'd expect that we'd still be viewed as 'under appeal' and not
      be expected to pay up. Although I'm sure Hector will be
      sending out newsletters and the usual nasty letters.

        Sorry to be a harbinger of doom, I know for myself that I just want this case resolved, but I assume that whichever side loses on Jan 19th will appeal, so we shouldn't get too excited?

          Surely if HMRC appeal, it would be on very weak grounds as they have breached the Human Rights Act.

          If we appeal, it's on very strong grounds, again breach of Human Rights act.

            Even when all HR arguments at the High Court are exhausted, there will still be the commissionaires (or tax Courts) to go through. Unless HMRC conceed, there is a long way to go.

              and I assume interest will continue to accrue while we sit here and wait? It is soooo one sided and completely loaded in their favour.. When a tax appeal is lodged interest should not accrue from the appeal date, it ridiculous! You are being penalised for asking for proof you owe something, weres the justice in that?

                And what about those who have yet to be informed of how much they supposildy owe? How can anyone manage their affairs when the pendulum swings one way.tantrum:

                  I think the FOI requests are starting to cause them a spot of bother.

                  This must have got them rattled because they replied bloody quickly for them.

                      Well, after the dodgy dossier from Timm's re how he had made it all soooo clear, and we were all bad people that had been warned clearly and consistently (insert any lie you like here), my MP backed off a bit. But I wrote back to him saying that I disagreed 100% with what Timm's said, gave my reasons, and asked for my MPs support should the revenue attempt to seize assets etc., to ensure that I was treated fairly and given a reasonable time to raise the money. Even for those of us who are lucky enough to be able to remortgage etc, it's not done overnight. My MP agreed. I suspect MPs may see this as being quite palatable, they don't have to side with us, but they are prepared to apply pressure on hector to make sure they don't get over-excited and kick in our doors. They're not defending tax avoidance, just making sure their constituents are treated fairly. As a defensive measure, it might be worth considering sending a note. Not, and I stress this, that I think we will lose. HMRC lose many times in the court, in circumstances nowhere near as controversial as this. They are way out on a limb, they must know that they have a very real chance of losing. DR and co have done a tremendous job on our behalf (thanks as always, and to those who attended court the other day). As a result, we are well informed and the scare tactics are just not so effective any more. Before this forum, I felt isolated and intimidated. I don't anymore. So I say, bring it on.
