    Positive Selection

    Anyone used this agency recently?
    I have used them for my last contract and they still owe me approx £9000 dating back to Feb (which they have received from the employer).

    The latest they have told me is that theiw accounts are currently frozen as they are being taken to court by the HMRC over an amount of 50K (which Positive Selection are aguing they are actually owed in a rebate).

    Anyway they say they cannot make any payments until then and if successful they MAY pay the outstanding amount over a period of time is possible.

    Anyone have any experience or advice to share?

    Why have you not issued a winding up order?

    If you wait you will be at the back of the queue when they go bust.

        They have asked me not to do anything until the 3rd oh June when the case is to be heard I am a bit suspicious of this as maybe if I dont take any action by this date it will be too late?

        So is this what I need to do? Issue a winding up order? they say I am currently a creditor like many others..

          The reason why they are asking you to wait until the 3rd of June is because they won't be around after that date. So get in there and get it sorted.

            The "agency withholding payment" question comes up about once a month. Do a search on here and you'll find loads of advice has been written before.

                    Best bet is search around on site here for advice. I can't offer any as when I was last in this situation I lost £15K, so try and get some advice from people who've succeeded in getting money out of an agency.

                    Oh and try not to get bitter and twisted about the whole thing. Didn't work for me, won't work for you.
