BN66 - Time to fight back (Chapter 3)

    Update on JR

    A letter is being sent out to clients over the next few days.

    Highlights
    • Our JR oral hearing is likely to be end of May.
    • However, we have been pipped to the post by someone else (possibly PwC). Their JR oral hearing is at the end of this month. They are going on same HR grounds but also another angle. Apparently, they reckon S58 breaches Art 56 of the European Convention on freedom of movement of capital.
    • Montpelier are also aware of another JR proceeding in the pipeline. (This is in addition to Steed/KMPG's EHCR application.)
    • At the moment, the courts have made no move to consolidate the various applications.


    Hopefully, we should know by next month if the first JR has got the go-ahead.

    Not long to wait now.

      Thanks DR. I'm feeling quite positive after reading that. Obviously some very bright people working for these companies that will demonstrate HMRC's bungling buffoonery for all to see

        Also I've had a reply from my MP (John Hayes - con), fairly standard but again on the 'nice' news side...
        "I do appreciate the concerns that you have raised in your letter. I have, therefore, written to the appropriate authorities, enclosing a copy of your correspondance, to request his urgent comments on this matter.

        Thank you for bringing this to my attention. I shall, of course, be sure to forward as copy of the reply that I receive directly to you.

            This is interesting/ worrying DR.

            The impliciation being that pwc have also had the initial application rejected? hence they are down the oral route... this is the process so I guess that must be the case.

            This I have to say worries me... i.e. two parties, with pwc being perceived as a 'big legal player'; presenting applications that were rejected..... I don't want to be negative but can draw no other conclusion, I hope you or someone tells me I am wrong.

            Also can we attend said hearing or get transcript of it thereafter?

              Yes that crossed my mind, but didnt someone earlier say that it was almost routine to have the written application rejected?

                Indeed, a senior partner at KPMG who has been involved in numerous high court cases, said it was quite normal.

                By the way, I don't know it is PwC, that was just an educated guess. We are currently trying to find out more details.

                  Get your MP to sign the petition

                  Just a quick message to everyone.

                  When writing to your MP, mention the BN66 (section 58) petition has received 570 signatures and ask them to sign. Remember to provide a link in the letter.

                  I have asked my MP Jeremy Corbyn to sign. So it will be interesting to see if he does.

                  Whether or not you're MP signs the petition may show if they really mean what they say!

                    Treasury still not replying...

                    Hello,

                    I wrote to my MP (Humfrey Malins - Con) again and he has replied saying he has "...written to the Treasury to ask that they now deal with the letter as a matter of priority..."

                    I doubt they will, but at least we are keeping them busy.

                      Regional Get Togethers ?

                      Whilst I look forward to the day that we all meet up to celebrate our victory, reading through the names on the petition I recognised a few and then found myself wondering if there is anyone working at the same place as me who are also affected by this and would intersted in meeting up.

                      This could be expanded to same/close towns etc ?

                      Perhaps people would shy away from saying on here where they live/work ?

                      Just an idea, any thoughts ?
