      they just dont get it do they.

      Once for all, avoiding paying tax is your legal right and I would say your duty under this government. Having avoided tax DOES NOT mean you owe the tax you avoided, it means you outsmarted the system.

        Oh I think they get it alright. It's just that they have reclassified avoidance as merely a lesser form of crime than evasion. A bit like cannabis vs. heroin.

                Feeling low and depressed is just feeding the dementors @ HMRC.

                  I have been through all the mental health/divorce thing. quite frankly the drugs they gave me just made me worse. much worse. I found exercise and healthy eating far better for me. though not nearly as good as the crazy things I did for fathers 4 justice. I look back and think what an idiot I was : but at the time it was incredibly theraputic. And as for those who got hurt : well they were asking for it : they deserved what they got. Maybe one day I will feel sorry for them : I hope so.

                  Anyway : at least your post will have cheered up HMRC head office : they dont get much happiness in their dreary lives.

                    as has been said, waaay - 4-1, effing magic. and as I mentioned a couple of posts ago, my mood is up at the moment.

                    I see Barclays have been up to no good re artificial arrangements to avoid tax. http://www.timesonline.co.uk/tol/new...cle5908523.ece

                    I insist the treasury introduce retrospective legislation to claw back the up to £1bn a year Barclays has cheated them of. If not I insist they treat us the same way and (as the printed article says) roll over..

                      Let’s remember that HMRC knew ALL about the Montpelier scheme since the early 2000’s and, frankly, appear to have decided to tolerate it. After all, they claim that the “Padmore legislation clearly applied”. If it was clear to them, but HMRC did not tell ANY of us, then what other conclusion can a man on the Clapham omnibus be expected to come to but that HMRC decided to tolerate this scheme?

                      To claim anything other is to accuse HMRC of either maladministration or dereliction of duty. Neither of which we have any responsibility for.

                      To those who have had closed (accepted) tax returns re-opened: how did HMRC know to bring your SAR under enquiry? Did you give them anymore information that the Trust opening form and the claim for DTA relief on your SAR? No? Neither did I. Which means they had all the information they needed.

                      HMRC’s attempt to re-open returns, and the case they are using, demonstrate that HMRC are determined to thwart the intention of Parliament. Parliament intended taxpayers to achieve certainty in the self assessment tax system – HMRC have gone 180 degrees against that. HMRC are operating to the letter of the law rather than the sprit of the law.

                      When one tosses a coin it can land on head or tails, but not both. You can’t have your cake and eat it. One cannot make a choice and not make a choice.
