    Christmas card from IR

    Foegive me but just opened a letter from the IR I thought was a NI demand. So.... I got a letter from the IR on the 24th saying my tax return claimed for relief whatever on this double taxation ruling and I was to amend my return etc and not to do any more claims. My m8 got one a week before and my other two m8's have not got a letter yet. MtM are on holiday and I was wondering does this mean i must pay up now and what is the interest situation they refer to? Does puting cash on account mean if MtM win the case I get my cash back? If MtM lose do the IR just keep the cash? Who decides what I owe? The other thing I noticed is they have my old accountant as the people that handle my tax affairs... Same also for my m8. They really are poor in that department..... Just feel like leaving the country and giving these people nothing as all the do is try to screw us for every penny to keep Gordon and his usless pals in power.... Is the share split with a limited company the way to go? Used to do that before until the Artic Software mess that the IR created..... What is the best way forward now if I stop using MtM as I don't need this going forward....

      Firstly, welcome to the forum, Flyer.

      Secondly, send a copy of the letter you received to Montpelier (MTM) who will appeal the Notice on your behalf. You/they have 30 days to do that so no panic.

      As regards who what and when to pay, there is no reason to make a payment on account. If you look at the links on the front page of this thread, put there by DonkeyRhubarb, you will find good information on how and why you might want to do a CTD (Certificate of Tax Deposit). There's a lot to read there but the links are a summary of the best posts on this site over the last 12 months or so. Its your life but investing the time reading it will get you on the ground runnng.

      A decision to stop using MTM is a separate question. You are now have different tax arrangements which at this time have not been challenged by HMRC. Its a separate decision. Solutions beyond there depend on personal circumstances.

        Agree with everything Emigre said : personally I went limited in October 2008. There were new income shifting laws due in April 2009 but now postponed. So I have limited 60/40 to me/gf and we both have a salary.

          Thanks all... I will read those threads but guess I will have to wait for MtM to open up again in the New Year to work out what I should put on account....

          Think I will go limited again in the new tax year.... Don't need this grief... But these new income shifting laws that have been put off.. Is that good thing or bad?

            Think very carefully before paying on account. In theory, you would get it back if MTM win but I can imagine it will be like getting blood out of a stone. HMRC will try all the dirty tricks in the book to avoid coughing up. They claim you would be due interest but I've studied the "small print" and it seems there is a sneaky way for them to wriggle out of that too.

            Remember, HMRC want you to pay on account, and that in itself should make you very, very suspicious.

            If you want to stop further interest accruing, then a CTD is a much safer bet. For more info, start here:

              Hi Brillo,

              Since you have left Montpellier half way through a tax year - will they still do your tax return for this tax year? If they don't how do you go about putting your funds received from Montpellier onto your tax form? As I am also looking to leave Montpellier this was one of the questions I needed answered!

                  How does one calculate what is owed? Does HMRC do that or does MtM do it? As I was just told by someone to look at the numbers and calculate 40% as owing. Is the letter I got just a investigation letter or a closure notice as I am confused?

                  Looked at the link for the CTD and that looks like the way forward. Is that what people are doing?

                    They will do a tax form for any year for which you have used the scheme. they might pass the details onto whoever does the otherhalf : but why take the risk of a f**k up? Best to give montp the other half (the easier bits) and let the experts do it.

                      I believe there is someone around at montp for all working days over the holiday period : but is it desperate you get an urgent response?
