    Given what Toocan has said, which seems thoroughly reasonable, I wouldn't be surprised if HMRC think that they will lose that they will offer an out of court settlement to avoid the courts testing the case.

    There are two questions that come out of this possible scenario, the second one applies if it goes to court and you get justice:-
    1. Would you settle with HMRC in effect admitting that you owe tax albeit a percentage of what HMRC have tried to claim?
    2. What would be the position on you claiming damages for the distress that HMRC have caused in their attacks on you people?
    If you do win (which I earnestly hope you do) then surely some of you will have a reasonable case for seeking damages for the stress caused.

      Personally, my answers are:

      1) No, I dont want to do a deal with HMRC. They can go whistle, I want justice to be done with maximum embarrasment for Her Majesty's Conmen.

      2) Yes, I will try and sue for damages. If we win the case, I would class the way HMRC have approached this as harrassment.

      My opinion is that Montpelier would not even want to talk about a deal at this stage.

        No and No. Why deal : we are going to win. No point in going for damages : earliest this will be over is 2012. Why prolong it by years and years?

          having taken it this far they obvioulsy thought they were onto a winner, therefore if they offer a deal they are admitting defeat ... so unless its an amazing deal why take it ... if they offer 10% i'd take it - but if they offer any thing around 50% or upwards ... not a chance and thats still loads and loads of cash

            They would have to PAY ME to not take this further, let alone pay them a percentage...

            If they offer me £10k to drop my action with MP and write off anything they think I owe, then I will think about it...

            APART FROM THAT THEY CAN GET F***ED!

            after all the personal stress Ive gone thru in the last year, including my marriage breaking down Im not in the mood for paying those M'fo's any money.

              As far as I'm concerned I acted within the law at the time that I entered into this planning arrangement and continued to act within the law throughout the time I used the arrangements. HMRC have not brought a test case to prove that this was not the case.

              Therefore, I am not interested in any offer or deal that starts with anything other than 0%. For that I may consider not following up with claims for stress, harrassment and so on. I will however pursue them when we win for not closing off my tax returns for all these years which has resulted in me needing a self-certified mortgage at a higher spread over base rate. Anyone for a class action?

                  No Deals - Ever!

                  The FUD created by Hector's time travel caused MtP to implement a loan based scheme. I have always been uncomfortable with loans especially as a 'clarification' later might require that they are repaid. As a result, during year 08/09, I dropped out of the new scheme and reverted to Ltd Co.
                  That is now costing me around 20% pa in additional tax exposure, not to mention possible IR35 risk (I said....Don't mention IR35 risk).
                  No deals for me - ever.
