    Incidentally, I have asked MontP to give it to us straight.

    Our assumption up to now has been that we wouldn't have to cough up until the final appeal was lost. If this is not the case and we may have to pay on account within the next few months, then I for one would rather know now.

      It sounds like the Revenue's tactic now is to force us in to paying on account, irrespective of any JR/ECHR challenge. If we appeal against the Jeopardy Ammendment and request a postponement of payment, they will immediately take this to the Commissioners to uphold it. Given the law as it now stands, I'm not sure how MontP can stop this but I guess we will find out in the next couple of days.

      If we have to pay on account, HMRC will be happy to sit back and let the legal process drag on for years. Once they have got the money, can you ever see them handing it back?
      I have been told by MontP that "there should be no question of jeopardy assessments as HMRC will have sufficient information to issue closure notices from the returns submitted together with the partnership accounts."

        It is all very well MontP saying "there should be no question of jeopardy assessments".

        Previously, they said HMRC couldn't reopen returns after the Jan 31 deadline, but they did. MontP didn't expect retrospective legislation either. When you are dealing with this animal it is best to expect the unexpected.

        Did they say what their response would be IF the Revenue did issue jeopardy assessments?

        Any idea what happens next if (as MontP expects) they issue closure notices instead?

          Have you actually asked MontP. We could go round in circles supposing all sort of scenarios, but I suggest you bombard them with questions as I am doing.

            There is usually a way round most things.

            This is just another pyschological blow from Mr Brannigan ( BTW hello ) - in some ways it cheers me up. If they had a good case - why go to all this below the belt stuff?

            If anyone gets into severe hardship making payments after all this torture they will ge well up for revenge/retribution. I am not going to get involved personally - but I have some very very effective techniques that I intend to pass on! This could get fun!

                Yes, and I am waiting for a response but I thought perhaps you already had the info. I would rather not "bombard" them with questions as they are being inundated at the moment. I have asked them for a statement that I can post here which might save them yet more phone calls and emails.

                It's about time they sorted out their client communications. They certainly wouldn't win any awards for customer service!

                  I onder how many people received the letters today? 1000? 2000? I bet 500 emailed then phoned. Then phoned again! If those people read this thread and Bernard posted it would save them alot of time!

                    TBH, its best to work on the worst case scenario. MP have lost the plot big time and they know the game is up. They just dont want to admit it to us.

                    I sent another email to MP on 18 July. And guess what? Not a peep out of them. No acknowledgement, nothing to say sorry we're very busy etc, etc.

                    When I get the assessment from HMRC, I'll pay up because it'll stop the concern about which way this is going to go and should stop the bill going higher (thanks again MP for advising me NOT to pay on account because 'their position is (was) so strong'!

                    MP were also wrong about not opening SA's after 12 months. The IR, now HMRC always had powers to go back 6 - 7 years.

                    EDIT: I havent received any notification from HMRC as of today either. Haveother people been receiving 'pay up or else' letters from them?

                      I would prefer to wait until the tax councel give their view. Mr Brannigan has landed a couple of punches (below the belt) but mp are not out by a long way.

                      If you want to pay - then pay. HMRC know they will pick off a few. But most are going to fight on. But why post the above publicly where Mr Barannigan can read it? I bet he is loving this...
