          The case is very weak in that the will of parliament is such that I don't see anyone looking on this case favourably, as is demonstrated by many individuals on this thread. As such, I am doubtful about a JR getting granted.... but as I am affected, I have to be hopeful.

          However, it upsets me that just because contractors take advantage of complex tax planning, the mob are out to poke fun and have a go, instead of taking a stance against the idiots who undermine the legal process for everyone, i.e. our shambolic government. I personally don't mind paying tax, but get it right up front. I would also suggest there are elements of discrimination in the new laws, i.e. the wording could be slightly changed to widen the net significantly, but of course this would nail some very big political fish and of course cause issues for the government.

          Regarding the business of clarification; some individuals keep alluding to the fact it is an open and shut case, i.e. the law was already in place etc. If it were that simple why wasn't the same action taken 5 yrs ago and save everyone a lot of time and money? The legal process is never an open and shut case....

            BTW my ex works HMRC too - I could tell a few stories of the things they get up to. but not on this thread. It is not nice.

                  From my perspective the government are doing the equivalent of saying:

                  Dear general public, you know we have been charging you £100 a year for car tax, well weve been having a think over here at Hector HQ, and now we think that it should have been £150 for the last ten years. So we are going to send you a tax bill for the difference for the last ten years.

                  thats the issue I have and on the basis Hector knew about this for the last 6 years its even more lame to now implement retrospection or clarification or whatever you want call it, the outcome is the same...backdated charges
