Did you actually have a coy of a contract, any contract and it just wasn't signed? Seriously - is the 3.5 days earnings worth it? You got paid something didn't you, just not the difference in rates?
Just take this on the chin as a learning experience and never work again without have agreed the rate and having it all signed in a contract.Comment

The agent issued a payment through my umbrella website, but did not accept it since it was for the wrong rate and less days of work.
I don't want to push the agent too much since I don't know what power they have (i.e. in case the agency bad mouths me to other agencies etc..)
So for my next contract, do I ask the agent to send me the contract prior to the start date so I can sign it?

Yes next time before you start make sure you get a countersigned copy from the agency with the agreef rate/terms etc.
Agencies will threaten to "blacklist" you but this is just bullcrap. They wouldn't even blacklist you because as soon as there's a chance for them to place you and make money off you, they'll be ringing.
I just didn't think it's worth your stress and time to chase only 3.5 days pay - I know it's a lot of money to some but your efforts are bext focussed on getting the next contract.Comment

If you did not opt out of the Agency regulations, then the agency MUST pay you for the work you did, regardless of whether they get paid by the client or not. If the client is not happy with your work, then the agency must still pay you, and it is up to them to sue you for unsatisfactory work.
If you did not opt out, then all you need is to prove that you were on site, and they have to pay you - if you have something from them that says "the client was not happy with work performed between XX-XXX-2007 and XX-XXX-2007", then that is enough proof to show that you were there, and they need to pay you.

I am now thinking about IR35. I have not signed a contract but I will receive payment (luckily!)

Here's a hint...you(we) are called "contractors". This website is called "ContractorUK".
Get and sign the contract, before you take a dump(at the client site)

Because I started work at the client side without signing a contract first since I went to the interview on Friday and started on Monday.
In order to receive the payment from the agency will I need to sign a contract at any point? Will the tax man ask my how come I received that money without any contract?
