    Could you elaborate on

    My situation is simialr to the posters ... Giant created a limited company for me. By 'created' I mean they asked me for details of a company name, directory, secretary, registered address, share split etc.. and then organised it all with companies house. They then closed down the operation and said they would have nothing more to do with my Ltd (all before 5th April). I continued the process and registered myself for VAT, Corporation Tax, PAYE and opened a bank account etc. Giant charged me a fee of £30 (before 5th April) and that was it.

    Am I ok to keep running this company? ... I hope so as I too have regsitered a Domain name etc.. !

    Hi,

    If all they did was set the Company up for you, and never had any control over the bank account or acted as a Company director/secretary then you will be fine to continue to run with the Company (provided of course you have a proper firm of accountants acting for you and not a rebadged MSC provider)

        I've not really been following the whole MSC thing as I've running a ltd for the last 3 years.

        However, my accountant has always acted as my company secretary. Is that not ok now?

        Also recently found out that my accountant was also providing MSCs as well if that makes a difference.

          Correct me if I am wrong, but didn't SJD provide an MSC solution? I think it was called SJD Solutions - or SJD Total Solutions.

          Does that make SJD a rebadged MSC provider?

            We did provide a small number of clients with a service which could be defined as an MSC, yes. However we only ever did around 40 of these, out of a total client base of around 5500.

            They were incidental and insignificant to our core business which means that the legislation could not apply to us as we were not "in the business of providing MSC's"

            Nice to know the competition keep such a close eye on us

              Unfortunately just a contractor, not a competitor.

              Just trying to keep you honest.

              Incidentally Simon, there is no need to justify your position to me, it's the HMRC status inspectors you need to worry about. You naughty little rebadged MSC provider.

                    Sorry,chubby I am simply a contractor, albeit a qualified accountant. You will see from my posts that I was with Giant Powerhouse. Not wishing to jump from frying pan, etc I have researched the topic and spoken to my local tax office - status team.

                    I am not going to be bullied by a dope like you.
