My current contract (outside IR35) competed end of Feb and I have started to look at outside IR35 contracts.

The ‘old’ client had decided to stop any engagements with LTD company contractors as a blanket decision, no SDS etc.

Now I have an opportunity to go and work for a small consultancy who already have an engagement with the ‘old’ client and would like me to offer an SOW based set of services to the small consultancy which will effectively offer services to the ‘old’ client.

The role would be a different role to what I had previously been engaged on with the ‘old’ client when I was direct and would be based on deliverables and milestone payments.

After some advice to see if there’s anything wrong with this approach ? And I’m under the assumption I would be responsible for assessing my status due to being engaged with a small consultancy company. So as long as I have the SOW contract correctly written and a set of working practices signed off by the small consultancy - this should be ok ?

Or have I completely got this wrong and am missing the point !!

Different role is good.

Sounds like the consultancy has a job to deliver and the client doesn't have input into who does the delivery, which is better than using the consultancy as an intermediary.

Worth checking how far down the supply chain the client is enforcing the PSC ban. The likes of Lloyds have decreed no suppliers can use PSCs which is really messing things up.

I'd say this would be ok.

If it's a ruse it's the client's problem or the small consultancy's problem, not his.
