    QDOS IR35 Insurance query

    I recently received a letter from HMRC about a couple of small mistakes on my SA.

    I put in a claim on my QDOS TLC35 policy in order to have some help in responding.

    They refused the claim saying I had made a similar mistake in the past and I should have known better. There was no route to appeal.

    Not sure the insurance is worth taking out if they refuse to honour it.

    I'll be taking IPSE+ next time!

    As someone who also has TLC35, it would be interesting to hear what these so called 'Mistakes' were if you wouldn't mind sharing. I think it is difficult to challenge a company and it's decisions without all the facts. Also another option maybe, is to send all the facts to IPSE and ask if they would have covered you, before you jump ship.

      The site says TLC35 covers...

      Representation costs up to £50,000 in the event of:

      ◦A PAYE compliance review


      ◦An IR35 dispute


      ◦A PAYE/NIC dispute


      ◦A VAT dispute


      ◦Any HMRC aspect enquiry


      ◦Any HMRC full enquiry


      ◦A Section 660A dispute (For an additional premium of £2​70 per annum you can also include cover for tax, interest and penalties as a result of a Section 660A enquiry. This option can be selected during application)
      Which one of those does your claim fall under? I didn't know TLC35 covered SA's to be honest.

            It was around benefits on my P11D that I did not include on my SA. They are claiming additional £1000 tax.

            It's not a huge amount, but I want to make sure I get the tax owed and the response correct, without a lot of correspondence back and forth.

              Ok, so I am not surprised Qdos didn't cover you in this particular scenario. It is your responsibility to sign saying your SA if correct to the best of your knowledge, but you clearly left out known P11d benefits. You can't expect them to try and defend that can you ? I would also guess that IPSE wouldn't either. To correct your SA properly, I suggest you get an accountant to go through it with you, no need for insurance specialists.

                Genuine question. What were you expecting out of the cover? Them to sort the mess out with HMRC, them to pay the extra tax? Or something else?

                  I was hoping they would analyse where the mistake was - me or HMRC and then advise me to pay the tax if owed and send HMRC a letter saying what we had done.

                  I've contacted my accountant now.
