You have a company with your brother but you both contract at different places? This sounds dreadful. What happens if your day rates massively differ? Dividends have to be apportioned in relation to the amount of shares held within the company; you can't just give yourself X and your brother Y - if he has six shares and you have four in a ltd. with 10 shares, divi's have to be apportioned 60% / 40%.

Also OP, if you did what most other people do and pay yourself the minimum wage and top it up with dividends, will this not limit the amount you will have to fork over to the ex wife?

Actually the messy situation of owning the company with his brother could help in this situation as clearly all the company's income isn't his personal income.

However in the long term it is best they have separate companies. Families especially siblings fall out over money and he needs to maintain the relationship with his brother as clearly they are close.
