You can opt-out of pension auto-enrolment but it doesn't mean the company doesn't have a pension scheme for it's officers."You’re just a bad memory who doesn’t know when to go away" JR -
my point is it implies you have no desire to expand/employ peopleOriginally posted by Contreras View PostYou could say something similar about Working Time Directive and National Minimum Wage. The legislation acknowledges exceptions for company directors so the rules can apply differently, or not at all. That doesn't imply you're not running a business, quite the opposite in fact.Comment

Not really since the decision can be easily reversed at any time. Same principle as not requiring ELI until needed.Originally posted by pr1 View Postmy point is it implies you have no desire to expand/employ peopleComment

A one man band can be a legitimate business.Originally posted by pr1 View Postisn't part of the contractors standard IR35 defence that we're running a genuine company and not just hiding behind incorporation for tax purposes? surely opting out of the pension thing doesn't help in that regard?
there's probably no case law yet but that's only because the pension auto enrolment hasn't really taken off across small companies yet - someone on one hand trying to say "look, look! I have the same expenses as BigCo!" while on the other hand saying "I don't need to opt in to the mandatory pensions enrolment because I'm only a one man band" is a bit inconsistent?Comment

You can expand without directly employing people so that argument does not work.Originally posted by pr1 View Postmy point is it implies you have no desire to expand/employ people"You’re just a bad memory who doesn’t know when to go away" JRComment

it's not me you've got to convince
edit - all I'm saying is that if it's just some online forms to fill in, i'm going to set it up in case I do employ people in the future - each to their own what you doLast edited by pr1; 17 August 2015, 07:46.Comment
