You can opt-out of pension auto-enrolment but it doesn't mean the company doesn't have a pension scheme for it's officers.

You could say something similar about Working Time Directive and National Minimum Wage. The legislation acknowledges exceptions for company directors so the rules can apply differently, or not at all. That doesn't imply you're not running a business, quite the opposite in fact.

Not really since the decision can be easily reversed at any time. Same principle as not requiring ELI until needed.

there's probably no case law yet but that's only because the pension auto enrolment hasn't really taken off across small companies yet - someone on one hand trying to say "look, look! I have the same expenses as BigCo!" while on the other hand saying "I don't need to opt in to the mandatory pensions enrolment because I'm only a one man band" is a bit inconsistent?

A one man band can be a legitimate business.
