    3 months into 6 month gig, no right to issue notice

    Personal, irreconcilable differences with a key permie see me wanting out of my lengthy contract.

    I haven't got another gig to go straight into, but I would be far happier being on the bench than I would be carrying on where I am.

    This is the first gig that I have wanted to walk from rather than finish contract/walk away or be terminated and I am a bit worried about being pursued for an unknown amount of compo by my current pimps (Lorien) if I simply state a professional period of courtesy notice that I will be cutting my stay short.

    I am sure my circumstances aren't that different to other people and that this path is fairly well trodden.

    Any ideas as to how to end my stay early and mitigate the risk of being found IBOC?

      Talk to the PM. Explain that the situation is untenable, but you are unable to leave the contract because you cannot give notice. They will either resolve the situation with the permie, or give you notice to leave.

        Bring in a sub?

        Might also be a way to get the client to terminate if the client refuses ...

          Worst case take an extended sickie, take another short contract and if the worst comes to it go back at least refreshed and away from it

            Man I hate this... Take a sickie... really? How is that gonna help anything? Does it give you extra rights or makes anything more believable? Surely it just makes you look like a liar which is going to make the situation even worse. You could be opening yourself up to breach as well no?

              Just because you have no notice doesnt mean you cant leave a contract early. If there are clear and irretrievable differences that inhibit your ability to perform the tasks need to deliver, you need to speak to the agent.

              A client nor agent will want someone on site who is clearly unhappy and cannot deliver to the standard required. They'll also want you out quickly so you dont sabotage any systems etc! That said, they may want you to stay until someone else can replace you.

              Talk to the agent, ham it up if you like. They wont keep you if you dont want to stay. The down side is you may be a long time getting another contract through the same agent plus, the client may never take you on in the future.

              But this is contracting after all and you might find both agent and client take you on sooner or later.

                This. In the best case the PM may step in and try to resolve the situation to your satisfaction. Failing that they might allow you to work a short notice period while they bring in a replacement and then off you go. Worst case they say tough s**t then you just walk. If your contract has MOO clauses just invoke them and you should be fine from a contract perspective.

                  This. Your RoS (you do have that in your contract, right?) gives you an easy "out".

                  Even easier still, is to invoke MOO (you do have that in your contract, right?) and simply tell the client that, whilst you're not terminating the contract, you are simply refusing any further work from them.

                    Which is fine if you haven't already agreed to do the work. If they have offered work (eg. "manage the project for the next three months" and you have accepted it, if you turn round and say "I'm not doing it" you may well find yourself in a difficult situation legally.
