Another Consulting Overseas Victim?

    I have also been tied up is this Sandfield Loan Scheme, having used Sandfield during the 2001/02 years. Having first received a very unwanted letter from HMRC in 2008 I registered with Chilterns/BDO. I did send the HMRC an offer of settlement in 2008 and heard nothing, I live offshore and had assumed (hoped) this had gone away. I received another letter from HMRC in Jan 13, he letter advises that a full hearing is scheduled for 20-24 May(then several months for decision), they apologise for the length of time and comment they assumed everyone would settle. They refer to a previous letter I have not received.

    It suggests settlement as an option again.

    Does anyone know what is going on? Chances of success? Have most settled? Appreciate any information.

      There are many people receiving HMRC Enquiry Letters.

      I would advise that you take a look at HMRC EBT Enquiries

      Also you may want to repost in a separate thread in the EBT sub forum for your own scheme.

        Consulting Overseas ... my opinion on the status

        Hi all, some of you may have already contacted me as I'm the guy that asked HMRC to pass on my details to you all in a letter some time ago, the intention was to at least have a sight of what we can do with collective action. Obviously Sandfield / Consulting Overseas has been dissolved (check Companies House) and Chiltern ... BDO are no longer involved, there is no one to pay for their services. However, I have been in contact with John Hood for continuing advice.

        My case is second in the queue with the First Tier Tax tribunal, the first case is being represented by Accountax. I can confirm this is due to be heard in May 2013.

        Some other facts ... there were approximately 500 employees of Consulting Overseas involved, over 100 of those chose not to settle and those cases are open. According to a letter from HMRC in the early days, if the case is not determined in their favour they will be obliged to return all that money, although I've seen correspondance from HMRC that denies this. I have a copy of the letter that makes this statement. So, in some respects HMRC would prefer there was no judgement against them as there is a lot to loose (those 400 settlements) rather than what there is to gain (100 new ones).

        There is a lot of anger towards Consulting Overseas and anger to chase the directors. Even if you could track them down, and go to court to prove fraud, do they have any money to pay you? Also, who will they claim is liable, Consulting Overseas UK was only an operating office, the operations were actually based in the Isle of Man. I think from the process I've been through in the past two years I'm reasonably well informed. I'd advise anyone to really understand the process around the tribunal, closure notices, and ask HMRC as many questions as you can to make sure you have as much information as they do.

        The reason your 'bill' is twice what you may think is because HMRC have assessed you twice, two different approaches to how they could apply tax. Ultimately they will only expect one to be used, plus interest.

        As I said, there is an informal group at this stage. What happens in May may set the scene for what follows but I prefer not to rely on hope.

                    NTRT have prepared a template letter for people to respond to the consultation. Please alter it in your own words.

                    HMRC will have to report to the Minister how many responses they got, so every letter counts !

                      Paul Courtney Bishopp did seem to favour the name Sandfield didn't he? Did anyone unearth any detail as to why?

                      Could it have been the name of the school that he attended, the name of the street that he lived on or perhaps the name of one of his holiday homes?
