    The HAYS contract PSCToA1011

    Hi,
    I spoke to QDOS this morning about having this contract version reviewed and they have told me that they have indeed worked with HAYS and had changes made to this contract.

    I am now going through the usual we don't change our contract rubbish. I am at the part where I have sent the No problems I am walking away email (and am indeed ready to walk)

    Anyone used QDOS or a competitor to get the HAYS contract changed of late? It might just be that the people concerned don't know or cant be bothered...

    Bauer & Cottrell negotiate on your behalf as a default (except with the Guardian cover which I cannot understand!) which is why I only use them.

    I dont know why qdos who, reckon they are the bees knees, leave you to do the negotiation as the default.

      Thanks, I will give them a call in the morning.

      I have emailed the client telling them how pumped up I am to work with them, and mentioned that the contract has some features that I am not so interested in agreeing to.

      I can already see the standard contract would fail IR35, so that is the first issue however I see little point getting a review if Hays won't modify the contract even in the event of the evidence being shown to them.

            My first three years was with them but oddly enough that contract was fine and I worked at home on my own equipment... That was why I was so saddened by this mess.

            Am hoping that the client will give them a gentle shove in the right direction tomorrow.

            Otherwise it's off to a few more interviews...

              We'll happily speak to the agency on the contractor's behalf and do so regularly. Quite often it seems genuinely easier for the contractor to do it themselves, which is why we give them the choice.

                    I had the same problem with Hayes about 2 years ago, contract failed QDOS review. The schedule wasn't specific enough about the project and just needed a one line change.

                    Hayes wouldn't change it and where happy to see me and another contractor walk. The client ended up speaking to Hayes saying they wanted us and didn't want to go through another interview process. Hayes eventually agreed to change the schedule to be more specific.

                    I also emailed the client and let them know I wasn't messing them around but needed a minor change to the contract. But I know from comments made by employees at the client that the agent painted us in a very bad light.

                    I've managed to avoid Hayes since then.
