    Hi all

    Q for all those in the know.

    I have a friend who is estranged from the father of her son and gets payment through the CSA based on his PAYE job. The thing is, he also runs his own company which has been operating for the last 5 years. He claims he makes no money from his Ltd, which begs the question why put in c25 hrs a week after a full days work on it! I smell a rat.

    He does not declare the Ltd as a revenue source to the CSA. So does anyone have any ideas on:-

    1) What documents can be sourced publicly from Companies House which may help (annual return?) expose him?

    2) How best to go about exposing this joker. CSA and HMRC? Surely he must declare all earning from both jobs on his self assessment?

    3) Who can help and advise - an accountant? Soliciter?

    I hope that with some evidence and areas which need to be investigated, an appeal can then be made to the CSA to review the figures.

    Now I appreciate that most of you on here are looking at this from the other angle (how NOT to show all earnings to the CSA) but this is for a friend who gets less than £200 for her son from the father. He then refuses to pay for anything else as he says it should come out of the CSA money. £200 doesn't even cover nursery fees.

    I think you'll finde most people on this board for for not hiding your income from the CSA and for taking responsibility for your kids.

    I think you can get reports from companies house showing turnover, profit & share allocation.

      I can advise you - Give her some of your own money. That would make a real difference and show that you really care.

        I might be worthwhile starting at the local Citizen's Advice Bureau.

        Other than that I think a solicitor who specialises in family law, rather than an accountant, would probably be the best person to offer advice. I believe a number of firms will offer a free preliminary consultation. Also, Legal Aid may be available. The Law Society is a good place to start looking.

          The main question is... does she know the name of the Ltd company? If so, she has an obligation to tell the CSA that name so that they can investigate.

          Also, does she have any shareholdings in the company?

          You could always speak to a solicitors to find out what to do, but as already suggested... she may want to speak to the citizen's advice bureau first.

            I dont think anyone on here thinks not supporting their children is good. Personally I think they give good men (who are the majority) a bad name.

            Is it possible this chap is creating company value rather than income?

            How do you know he spends 25 hours a week on it? What other info do you have? Why not pass on all this info to CSA.

            I would suggest getting last years accounts from companies house - cheap and will give you some info.

            I dont recommend accountants/solicitors - they will cost the earth and probably get nowhere.

            Are there any access issues with the child? How often does he see the father? Is the father happy with this? Or does he not want to see the child?

            Sometimes access issues spill over into money. There are 2 schools of thought on this - both have merits.

              I think my point about not not wanting to show all earnings was misunderstood. Most on here seem to pay what is due, but ex wives seems to want a whole lot extra for shoe collections and the like! Apologies to any I may have offended!

              I don't think this chap is not getting income as his business model appears to be buying stuff then selling it on.

              The 25hrs comes from knowledge that he spends around 5 hrs a night on it based on what some friends have said so it is anecdotal.

              This is all the info to date and I think it wil be more valuable to get some more from Companies House and then present it to CSA.

              Father is sporadic with his wishes to see the child. Often if he is annoyed with the mother he will cancel at the last minute. Sometimes it is weeks before he then decides he wants to see the child again.

                Could you get some of the friends to engage him and try to find out more?

                Anyone who lets arguments with their ex interfere with the best interests of the child is a total f**kwit. Just given that the posibility of hiding money becomes higher.

                  i thought the CSA couldnt take dividends in to account and they can only go off your salary??
