We received a letter from Winchester Contractor Solutions on Bank Holiday Saturday (great timing, we can't speak to anyone until Tuesday).

We used Winchester in good faith, having been told by a recruitment agent that we had to set up an umbrella company. Worst advice we have ever received, wish we had never heard of them.

Winchester advised us they met all regulations...this is not the case. We have emailed HMRC and have put a letter in the post disclosing all payments received by way of loan during tax year 2016-17. Another company set up by Winchester called Infinity has also gone under.

Waiting to hear from HMRC with a final figure on tax owed. We have written to the trustees to ask how we get a Deed of Release from the loan.

Not sleeping. Not eating, this is a total nightmare. We do not intend to sue Winchester. We will comply fully with HMRC to pay what is owed.

What are you going to sue them for? Being naughty boys? Employer loans and EBTs were and still are legal. I think you would be better advised facing up to the pickle you find yourself in and focus on extracting yourself with as little pain as possible.
