    Big Group is gearing up for a challenge on discovery.

    A word of warning though, HMRC will have to be dragged screaming and kicking into Court over discovery and the lower tier Tribunals will perform all sorts of logical somersaults to find for HMRC.

    According to this FOI response, from two years ago, around 500 of the 2,500 scheme users had already settled.

    I wonder how many of the 500 were recipients of dodgy discoveries and handed over money that was never legitimately in dispute?

    HMRC have already conceded, in writing, to one person that "discovery enquiries" are not valid.

    Clearly the officers who issued these notices, between 2004 and 2008, didn't understand the rules.

    HMRC should now do the decent thing and write to all several hundred people who received discovery enquiries and withdraw the associated closure notices.

    The FOIs are intended as a prod.
