Done this plenty of times in the past.
Alternatively I've extended the contract end date by two / three weeks to take time off while and rollover as normal.
So in your case extend to the end of January take December off, this way you can maintain your 'employed status'.

I would treat it as a new contract because the old one has expired and there was no continuance to the new one. However, it's unlikely to make any practical difference.

Re-Newal Break
Word on the contract re-newal street at my place is that I am going to finish my contract at end Nov, been stood down during Dec and then resume in Jan for another 3 month extension.
Not confirmed yet, but how good would that be ?
PS - would that require a brand new contract or merely an extension ? I may post this more formally in busines/contracts once clientco have confirmed this is happening.Tags: None
