It also depends on how the sum paid out by the insurance company was calculated.

IANAL but that should not be the case - employer should be claiming tax back from HMRC.

All depends on his contract of employment.
If he was entitled to be paid then he does not owe the company anything.
He may owe the insurers as he should not have received compo for loss of earnings.

If he was not entitled to be paid then sort it by stopping his wages in the next run as suggested before.

Check that the compo did in fact contain a loss of earnings lump.

Can't the employer jusr reduce the amount from next ru of payroll - that way the tax etc. implications should be calculated correctly. Getting taxes etc. correct on reverse payments can become a bitch.

My son had someone go into the side of his car a month or so ago, and was off work for a couple of weeks.

His employer paid him his full wage, but is now saying that the compensation included a loss of earnings figure and he should be paying his employer back.

Does he have to pay the gross amount including all tax and NI?
