    The only bearing it has on IR35, is that it proves, once again, that the courts will not imply a link between having 'employment rights' and being found to be inside IR35.

    And the sooner the protagionsits forget this idea, the better IMHO.

    This is what is all about, getting their paws on more tax. Couldn't care less about businesses or temp workers. They'd rather we all worked at Tesco and got £ 5 ph, in which case they'd know straight away what tax was due, instead of leaving it to ourselves to calculate/pay it.

    The difference is that HMRC got the full tax they wanted. Therefore what happens to the person is of little concern.

    Temp Doesnt have employee rights

    Article on CUK front page says the courts found that a temp didnt have any employee rights even though she had been there for 4 years, and it also makes reference to there being no implied contract. Ok she was a temp but could that case have some bearing on IR35, this temp must of attending team meetings, must of had no right of subsitution etc yet after 4 years they still failed to find an implied contract and she had no employee rights, if this is the case for her surely we as contractor cant be seen to be an employee. I'm probably talking total cr*p but just wondered
