Can't she sue for being denied a promotion due to incompetence...? I thought people of a 'non white complexion' could do that these days.... and her having been demoted and moved to an outside company doesn't exactly point to her being a high flyer... banks are ruthless - you make them money, they like you.
If there had been any other reason than her performance, presumably she would have sued at that point... but, now she knows whatever ther merits of her case, or lack of them, ING will pay her off to avoid bad publicity.

Asian names are damn difficult to remember. There's a nice bloke at current place I've worked with before but damned if I can ever remember his name. He always says hello x when we pass and I just go, hi. I peer at his name badge pretending not to and vow to remember next time but I never do.
