Contract Wording (Unlimited Hour)

Hello all.

I see hours have been discussed quite a bit recently. I have a similar problem with a new permanent position I've been offered, to tide me over in the current climate. It's an American company, but in the UK.

The clauses I have an issue with are:

Conform to such hours of work as may from time to time be reasonably be required of him and shall not be entitled to receive any additional remuneration for work performed outside his normal working hours.
Normal Working Hours:
Due to the nature of the Network Engineer’s role he will be required to work outside or beyond normal working hours or at weekends or on holidays where the company considers necessary.

Surely this is not acceptable? Is it even legal? There is a verbal time in lieu arrangement, but having had a bad past experience, I prefer things to be written in the contract.

This is a contractors forum.

However the clauses are legal.

If you haven't signed out of the Working Time Regulations then you won't be working more than 48 hours a week over an average of 17 weeks.

Do you spot what I have done? This is a contractor forum not a permie forum. The nature of the types of contracts we work to are a different beast but...

Does it say anywhere else about hours per week? I don't think you have linked everything we need to know.

If it says 40 hours a week. If you have a job where you are on call out or at the mercy of a clients working times this seems reasonable. You can't have a 9 to 5 job when your role is to fix networks while the client isn't working.

Doing extra hours for no extra cash is something most people do anyway. The only thing is it usually isn't written down so yes it does look pretty tulip on paper.

You need to read your roles and responsiblities again and look for more information such as agreed working times. 8 hours a day, 40 a week or something. Is your role working outside working hours. Without these they have carte blanche to make you work every hour god sends according to that but I am sure it is not the case.

If you don't want to work out of hours on a very ad-hoc rota I would say you have picked the wrong job.
