Being a student is no more employment than graduate is a profession.

Uh, I may be wrong but I think when they say "employment" they really mean "what have you been doing for the last 3 years".

Not explaining what you've been doing will definitely get you a "fail" on your application, just put down that you were at Uni and detail what course(s) you were doing. If you need references then give them the names of a couple of lecturers that are willing to help out. Simples.

Hi guys, I have just finished uni and have been offered a contracting role, green as grass to this at 21.

Is there problems with getting SC when having been at university? I had great difficulties filling in the "employment" sections when I have been at uni for the past 3 years.

Also do l/should l set up my LTD prior to SC being granted or wait till after??

Also with regards to IR35, the place I will be working, government based, I doubt they erm change their contract wording to meet IR35 criteria...??

For employment you need to put down what your employment was i.e. student, there are plenty of fresh graduates and year in industry students that manage to gain SC clearance.

by all means setup your Ltd company if contracting is your choice and business / career plan.

In terms of negotiating, it depends if you are known within your industry or not, as most people will say it is working practices that can determine you IR35 status. most Government departments will contract on either a man power sub or EMR ( contracted services) basis. the former is a IR35 mine field and the later not so. However if you are known in the arena and proven to do a good job it is possible to negotiate aspects of the contract HOWEVER, you need to have the contacts within the organisation that require you to network and understand how things are done. Mind you this is fairly easy if you are programme managing and have to deal with the commercial side of the organisation rather than a developer working under a team.

Also read all the new guides to the right and elsewhere on the site. I imagine you contract is with an agency and they can be felsible with contracts. You will also learn when push comes to shove an IR35 friendly contract means squat when your working practices are not friendly.
