Hmmm yes I could cross out and send. I was so bloody angry though I just fired the email off.

I thought the clause would be unenforceable too but again I thought the point had to be made to them that I was exceedingly unhappy about the whole thing. Still we'll see if they get back to me or if they just ignore the whole thing (which to be honest is what I'm expecting).

You can ignore it. Designed to make nervous contractors insist on going through this agency for any possible future roles at that client.

It's an unenforceable restriction of trade, so you can sign it and keep them sweet if you want. Chances are you'll never 'breach' this clause anyway.

Cross out what you don't like, initial, and sign it. Make a witness copy if you're feeling arsey. Then send it back.

Why do you ask for clauses to be removed?

I am currently talking to an agency, who I shall not name but let's say they have a lofty reputation. My CV was forwarded to the client who want to interview me, and we're now discussing dates.

This afternoon I get an NDA land in my inbox, requesting I sign and return. Fair enough thinks I, but I'll just have a quick read first.

Cheeky buggers. As well as the usual NDA stuff, they have put in -

- a 6 month restriction clause about working for the client even if I don't get the contract
- an agency regs opt-out

All under the guise of 'just' an NDA. I'm fuming.

Right now I've replied very politely asking them to remove the clauses. Sadly it's actually quite a decent contract so I don't want to tell them to sod right off but believe me I'm tempted.
