If you're going direct, join the PCG (actually, join them anyway!)and use their standard contract. That's about as IR35-prooof as you'll get contractually. Plus if you're doing a specific piece of work on your own resources for a set fee, that's pretty much solid as well - to the extent that an RoS probably won't make a huge difference.

First contract :)
Hi Everyone
Got my first contract postion!!! Wooo hooo!
The company needs a peice of software developing and I will be creating it at home ("business address") and I will probably building it for a fixed fee (maybe bill them for the total hours). We are still discussing the finer points. I will have a clause in the contract to cover substitution. If Mr Tax man comes knocking I will say my subs would of come from Elance or somewhere similar.
This to me sounds outside of IR35 would you guys agree ??Tags: None
