Agreed, are you contracted for daily or hourly rate? I am on a daily rate so a 5 hour day or 12 hour day is all part of the role.

And, of course, if you're on a day rate, who's counting hours worked anyway...?

I had one that said 40 hours for the week, but the extension only said 37.5 (which I think was just a mistake by the agency). It just meant I felt a little more justified in going early a couple of days a week.
I wouldn't worry about it if I were you. If they're happy with the service you're providing, and you're happy, neither of you should be specifying hours.

Sounds like an opportunity to get some more money out of the agency!
Your contract says 37.5 hours a week, therefore that's what you are obliged to work. If the agency now need you to work that extra few hours, then double time should do it.
They would be (and are!) the first people to screw you over a rate, so you may as well try to recover some of it back.

What the agency/client contract says is a complete irrelevance to you.
If the agency contract with the client is different then that is their problem. You may choose to work 40 hours or more to help them out of a spot, but that's fown to you.

37.5 hours is what it says in your contract, and that is all you have to do. I presume you're being paid for everything over that?

Contract Question
Long time reader, first time poster and any help would be greatly appreciated.
I have what I believe should be a standard two way contract with my agency and company I am contracted to. I am into my third 6 month contract with the same company and am contracted on a daily rate. My contract with the agency lists a day as being 37.5 hours. Imagine my surprise when after having a chat with HR here I discover the agency contract with my employer states 40 hours. This has not been a problem as in all the months I have been working I have always worked over 40 hour weeks. The agency (and they are one of the big ones) were rather confused when I told them this and are looking into it.
Does anyone know what my options are here? I have 3 months left on this contract and am not sure where I stand.
