    Opting in or out has no impact on your IR35 status. It your contract terms and what you actually do on the job that puts you inside IR35 or not.

    As you can tell (with the comment above) this topic has been covered to death on this forum and a quick search will lead you to quite a few threads.

    If your still confused then give the DTI Agency Standards Helpline (http://www.dti.gov.uk/employment/con...nts/index.html / +448459555105) a call and they can answer any questions you may have.

    In the end it is really up to the contractor whether to opt in or out. And remember you are opted in until you opt out.

    Opt in/out has no impact on IR35, excpet that by saving the agency some work you can trade for better contract clauses. Whether or not they do any good is another question.
