    Depends what you mean by "had" ? If you mean "signed a contract containing such a clause" then no, but if you mean "has an agency ever tried it on" then yes.

    You need to explain really clearly that the term is not acceptable and that you will walk unless it is completely removed.

    Congrats on actually reading the contract though, shows you are cut out to be a contractor IMHO

    Hello,

    I received the contract for a nice project, but the indemnity clause seems terribly heavy to me...

    They're asking my company to indemnify and keep the agency indemnified for pretty much any possible thing: any and all liabilities, claims, losses, expenses, ....). but they even specifically include "legal costs" in that list.

    This seems over the top to me.
    Anyone else had an indemnity clause where the agency wants you to indemnify them for legal costs and professional advice?
